Dental appointment reminders

Reminders cut no-shows, and HIPAA allows them. The rules that bite are mostly about how they are sent: what goes in the message, how the patient asked to be contacted, and consent for automated texts and calls.

HIPAA

HHS says covered providers may communicate with patients electronically, such as by e-mail, if they apply reasonable safeguards — for example checking the address before sending and limiting the amount or type of information in unencrypted messages (HHS FAQ 570 (opens in a new tab)). Patients can ask to be contacted by alternative means, and HHS gives the example of accommodating a request for e-mail reminders instead of postcards. A vendor that sends reminders using your patient list is a business associate.

FCC rules for automated texts and calls

The FCC’s consumer guide says its rules ban autodialed texts to mobile phones unless the owner gave prior consent or the message is for emergency purposes, and require consent for autodialed or prerecorded calls and texts to wireless numbers. Informational texts can rest on oral consent; commercial texts need written consent. Patients may opt out at any time in any reasonable manner. Calls using AI-generated voices count as artificial under the TCPA (FCC, February 2024).

A safer reminder set-up

  • Record how each patient wants to be contacted, and their consent
  • Keep messages minimalDate, time, office name, and a call-back number — not the procedure.
  • Honour opt-outs immediately
  • Sign a BAA with the reminder vendor
  • Check promotional messages separatelyRecall and marketing texts can need different consent from appointment reminders.

Common questions

Can we text appointment reminders under HIPAA?
Yes, with reasonable safeguards and minimal information, and respecting a patient’s request to be contacted another way. FCC consent rules also apply to automated texts.
Do patients have to opt in to reminder texts?
For autodialed texts to mobile phones, the FCC requires prior consent; informational messages can rely on oral consent. Ask counsel how your consent process should be documented.
